Welcome to MarketGem. By accessing or using our website at marketgem.ca, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the service.

1. User Agreement

By creating an account or using our services, you confirm that you are at least 18 years of age and are legally able to enter into a binding agreement. You agree to provide accurate, current, and complete information during registration.

2. Services

MarketGem provides market intelligence reports and lead generation services for real estate professionals in the Niagara Region of Ontario, Canada. Our services include:

• Free monthly newsletter with key market factors
• Paid subscription for comprehensive market reports, dashboard access, and priority alerts
• Lead capture and referral to partnered real estate professionals

3. Subscriptions & Payments

Paid subscriptions are billed monthly through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period.

We reserve the right to change subscription pricing with 30 days' notice to existing subscribers.

4. Intellectual Property

All content on MarketGem, including reports, analysis, data visualizations, and website design, is the intellectual property of MarketGem. You may not reproduce, distribute, or create derivative works from our content without written permission.

5. Disclaimers

MarketGem is not a licensed real estate brokerage. Our market reports and analysis are for informational purposes only and do not constitute financial, investment, or real estate advice. We make no guarantees about the accuracy, completeness, or reliability of any information provided.

Real estate decisions involve risk. Always consult with a licensed professional before making real estate transactions.

6. Lead Referrals

When you submit your information through our lead form, we share it with our partnered real estate professional(s). We do not guarantee any specific outcome, response time, or level of service from referred professionals.

7. Limitation of Liability

To the maximum extent permitted by law, MarketGem shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services, including but not limited to loss of profits, data, or business opportunities.

8. Termination

We reserve the right to suspend or terminate your account at any time for violation of these terms, fraudulent activity, or any other reason at our discretion. You may delete your account at any time by contacting us.

9. Governing Law

These terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to conflict of law principles.

10. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or website notice. Continued use after changes constitutes acceptance.
